Outside Goldman, Bomb-Sniffers and Barricades

"The public outrage over Wall Street’s rich bonus culture apparently had Goldman Sachs so rattled that the bank had police barricades and bomb-sniffing dogs outside of 85 Broad St. Thursday, as it prepared to release earnings, The New York Post reported.

In a surprising concession to the public outcry over big Wall Street bonuses, Goldman broke with the longtime industry practice of earmarking roughly half of its annual revenue for compensation. Indeed, the bank did the unthinkable for the final months of 2009: It subtracted about $500 million from its pay pool, rather than add more money to it, even though the bank earned a healthy $4.95 billion for the quarter, above Wall Street expectations.

Goldman’s chief, Lloyd C. Blankfein made no public appearance on Thursday as Goldman disclosed its 2009 financial results. Instead, in a terse statement, he referred to the full-throated outcry under way from Washington against Wall Street’s big paydays while the rest of the economy was still suffering: “Recognition of the broader environment,” he said, had prompted the firm to moderate what it could have paid its employees."

Financial News: New Glass-Steagall Will SHAKE Private Equity

" Following President Obama's shock announcement yesterday of plans to strip banks of their private equity interests, Financial News looks at the U.S. and European banks' exposure to the asset class.

The White House issued a statement yesterday, in which it said: "No bank or financial institution that contains a bank will own, invest in or sponsor a hedge fund or a private equity fund."

The rule in its present wording could potentially force banks to dispose of both their direct private equity arms and also their substantial fund investments in the asset class.

Should European politicians decide to follow the U.S.'s lead, as some expect, there could be a big impact on the powerful investment houses in the banks based in the region.

Tim Syder, deputy managing partner of U.K. mid-market buyout firm Electra, said a similar move in Europe would have a greater affect at the top end of the private equity market. He said: "There is going to be less private equity competition in the market as capital will be more expensive. Where it is going to have an effect is that banks are not going to be investors in funds. Funds will be harder to raise but I think that would have happened anyway."

The move is likely to further precipitate a decline in banks' holdings in private equity, which made up about 50% of the asset class in the 1980s, according to industry insiders. Bank investments in private equity now make up 9% of fund investments, according to data provider Preqin.

Bruce Ettelson, a partner at law firm Kirkland & Ellis, said: "In a world where there is less capital available for private equity and hedge funds, this will take out another source of funding.

"Banks unloading their stakes into the secondary market could cause a decline in prices and have an adverse affect on the very institutions that government is trying to buttress."

Obama’s Move to Limit ‘Reckless Risks’ Has Skeptics

The president’s proposals to place new limits on the size and activities of big banks rattled the stock market, but banking executives were perplexed as to how his plan would work. Indeed, many insisted the proposals, if adopted, would do little to change their businesses.

Moreover, it was unclear if the twin proposals — to ban banks with federally insured deposits from casting risky bets in the markets, and to resist further consolidation in the financial industry — would have done much if anything to forestall the crisis that pushed the economic system to the brink of collapse in 2008.

Mr. Obama appeared to be leaving crucial details to be hashed out by Congress, where partisan tussling has already threatened another reform the president supports — the creation of a consumer protection agency that would have oversight over credit cards, mortgages and other lending products.

Wall Street figures, many caught off guard by the news, reacted cautiously.

“I am somewhat skeptical about how much the federal government can actually regulate,” said John C. Bogle, the founder of Vanguard, the mutual fund giant. “We need to try, but all the lawyers and geniuses on Wall Street are going to figure out ways to get around everything.”

7 More Indicted and On The Hook For Years of Financial Crimes...

"Among the newly indicted defendants are Craig Drimal, 53, whom prosecutors said worked in Galleon's offices but was not employed there, and Zvi Goffer, 33, who worked at Galleon and later started the Incremental Capital trading firm.

Others indicted include three others associated with Incremental: Zvi Goffer's brother Emanuel Goffer, 31; Michael Kimelman, 38, and David Plate, 34; Arthur Cutillo, 33, who had been a lawyer at Ropes & Gray LLP; and another lawyer, Jason Goldfarb, 31. All live in the New York metropolitan area.

Each of the seven defendants was accused of securities fraud and conspiracy when the government in November announced an expanded probe.

The latest indictments add an additional count of conspiracy and three new fraud counts. They allege the defendants were involved in conspiracies to trade on insider tips about companies that were acquisition targets, including Hilton Hotels Corp and technology company 3Com Corp."

China's worryingly good results

"The challenge for the Chinese government now is to stave off inflation and ensure the stimulus goes into productive investment.

While the world economy is still trying to emerge from recession, China is showing signs of economic overheating. The nation's statistics bureau announced yesterday that gross domestic product rose 10.7% year-on-year in the fourth quarter of 2009, which brings economic growth for the full year to 8.7% and confirms that China is on course to overtake Japan and become the world's second-largest economy.

Industrial production jumped by 18.5% in the year to December, while retail sales increased by 17.5%, boosted by government incentives for purchases of cars and electrical appliances. The government said the gain in retail sales last year was the biggest since 1986.

The figure didn't come as a surprise since towards the end of last year nearly all sectors in China received significant financing from banks that hastily issued loans under the government's order to fund a massive stimulus package. The 12-month consumer price inflation rose to 1.9% in December.

Beijing's Rmb4 trillion ($585 billion) economic stimulus plan, announced in November 2008, generated more than 85% of the country's overall economic growth last year, partly because China was already in the midst of nationwide infrastructure improvements when the crisis hit."

Obama Moves to Limit ‘Reckless Risks’ of Banks

"Declaring that huge banks had nearly brought down the economy by taking “huge, reckless risks in pursuit of profits,” President Obama proposed legislation on Thursday to limit the scope and size of large financial institutions, The New York Times’s Sewell Chan reports from Washington.

The changes would prohibit bank holding companies from owning, investing in or sponsoring hedge fund or private equity funds or engaging in proprietary trading — what Mr. Obama called the Volcker Rule, in recognition of the former Federal Reserve chairman, Paul A. Volcker, who has championed the restriction.

In addition, Mr. Obama will seek to limit consolidation of in the financial sector, by placing curbs on the growth of the market share of liabilities at the biggest firms. An existing cap, put in place in 1994, put a cap of 10 percent on the share of insured deposits that can be held by any one bank. That cap would be expanded, officials said, to include liabilities other than deposits."

Top Tier Bank of America / Merrill Employees Likely to Depart Due to Lagging Bonuses

"

Bank of America ML revealed its new and exciting bonus structure yesterday, and while the dearly departed Ken Lewis would remind everyone they should be thankful they’re getting anything, unlike some people [this guy], employees are apparently not so keen on getting very little cash and stock paid out over the next decade.

The math works as follows:

If bonus is:
-> between $100k and $250k, only 35% in CASH, next 17.5% in STOCK in Aug 2010, next 17.5% in Aug 2010 in STOCK and last 30% in STOCK over 3 years

-> between $250k and $500k, only 24% in CASH, next 18% in STOCK in Aug 2010, next 18% in Aug 2011 in STOCK and last 40% in STOCK over 3 years

Employees at associate and VP level are highly disgruntled given JPM / MS and even Citi giving significantly more cash."

China Losing to U.S. Among Investments of Choice (ON BUBBLE FEARS)

" Jan. 21 (Bloomberg) -- Investors have turned bullish on the U.S. while tempering their enthusiasm for China as they worry about a market bubble there, according to a Bloomberg survey.

An overwhelming majority also see a government debt default on the horizon this year, according to a quarterly poll of investors and analysts who are Bloomberg subscribers. Greece is considered the riskiest government, followed by Argentina, Russia, Ireland, Portugal, Italy, Spain and Mexico.

Sentiment toward the U.S. investment climate has flipped in just three months. Almost six of 10 respondents are now optimistic about the U.S. while a majority held a pessimistic outlook in an October poll. A nine-month rally in U.S. stocks has pushed up the Standard & Poor’s 500 Index 68 percent through yesterday’s close.

“There appears to be a surge in interest in the U.S., and it’s in marked contrast to tepid attitudes only three months ago,” said Ann Selzer, the president of Selzer & Co., a Des Moines, Iowa-based polling firm that conducted the survey.

“American consumers are regaining confidence, and with that alone, there should be no impediments for current business to resume the growth of the past decade,” said poll respondent Drew Beatty, a commodity derivatives sales analyst with Wells Fargo & Co. in Dallas.

The number of U.S. investors who see their economy improving has steadily marched upward over the past two quarterly polls, more than doubling since July.

Tie With Brazil

China, the world’s fastest-growing major economy, is viewed as a bubble by 62 percent. About one-third of respondents said China offered the best investment opportunities over the coming year, almost tied for first place with the U.S. and Brazil, though down sharply from October, when 44 percent ranked China best."

BREAKING NEWS: GOLDMAN CUTS COMPENSATION

"BOSTON (MarketWatch) -- Goldman Sachs Group Inc., a prime target of the backlash after the financial bailout, on Thursday said it cut a key compensation benchmark to the lowest level in its history as it tries to soften criticism over fat bonuses.

In its fourth-quarter earnings news release Thursday, Goldman /quotes/comstock/13*!gs/quotes/nls/gs (GS 166.03, -1.76, -1.05%) said compensation-and-benefits expenses were $16.19 billion in 2009, or 35.8% of net revenue.

The percentage fell from 48% in 2008, Goldman said.

The Wall Street firm, which has faced public anger about its recording big profit after accepting bailout funds, said total compensation and benefits have decreased by $4 billion, or 20%, since 2007.

In the fourth quarter, compensation was reduced by $500 million to fund a charitable contribution, Goldman said Thursday."

BREAKING NEWS: China 'becomes world's second largest economy'

"The Chinese government also said the growth in the final quarter of 2009 accelerated by 10.7% from 2008.

But analysts say currency fluctuations make it difficult to compare China and Japan, and some experts question the accuracy of China's figures.

Japan announces its latest GDP figures next month.

Its economy is likely to have contracted by around 6% in 2009.

'Right direction'

The announcement was made by China's National Bureau of Statistics (NBS).

The figures have exceeded the targets set by the Chinese government, the BBC's Chris Hogg in Shanghai says.

A government spokesman said China has recovered from the global downturn and was moving in the right direction.

China was hit by the world economic crisis during late 2008 and early 2009, but not as badly as other countries.

It recovered with the help of a massive government stimulus package."

$62.1 billion paid by AIG to bank counterparties a "backdoor bailout"

" WASHINGTON, Jan 20 (Reuters) - U.S. Rep. Darrell Issa, the lawmaker investigating insurer AIG's payments to banks, said on Wednesday the Federal Reserve Bank of New York's submission of documents to a congressional committee is "incomplete."

In response to a subpoena, the New York Fed on Tuesday delivered over 250,000 pages of documents to the U.S. House of Representatives Oversight and Government Reform Committee relating to AIG's payments to credit default swap counterparties after its September 2008 bailout.

The panel is gearing up for a hearing next week into whether the New York Federal Reserve Bank improperly limited public disclosure on AIG's use of public funds to repay in full banks who bought its credit default swaps.

"Unfortunately, the document production is incomplete and not in full compliance with the committee's subpoena," Issa, a California Republican, wrote in a letter to Rep. Edolphus Towns, the New York Democrat who chairs the panel.

Lawmakers are angry at the Treasury Department and the Fed over the AIG bailout, which cost about $180 billion, and over bonuses paid to AIG executives."

China Is On a Monetary Treadmill

"NEW YORK—With a string of credit-tightening measures, China's authorities have subtly demonstrated their concern about a speculative, inflationary buildup in their country's property and stock markets.

What isn't clear is whether these steps are a precursor to a more dramatic measure—a revaluation of the Chinese yuan—or an alternative to it. Although analysts are increasingly predicting a yuan appreciation, there is still no indication that Beijing is willing to weaken its hitherto successful fixed-exchange-rate model for boosting exports and driving economic development.
Commentary

The problem is that credit conditions and exchange rates aren't mutually exclusive. The more the authorities show their inclination to tighten policy, the more speculation over a currency revaluation grows, the more "hot money" inflows enter the country in a bid to profit from such a move."

Dick Bove and Vikram Will Ride Into the Sunset

"Dick Bove’s weird love story with Citi is one that is complicated and needs a lot of nurturing. Although it will never reach the highs of the one he had with BofA (Ken Lewis was a “visionary and tactician” who “was torn from his post by politicians lacking any of Mr. Lewis’ skills and successes.”) our Rochdale analyst friend is still full of hope.

Bove said in a report today that Citi -which reported a $7.58 billion loss in the fourth quarter -needs to be destroyed before it can succeed. The firm will be able to “emerge from the rubble” once it sells what he delicately describes as its “remaining lagging operations”: commercial credit, The Associates, Primerica, the remainder of Smith Barney and large portions of its mortgage and other weakened consumer portfolios."

Morgan Stanley Allots 62% of Revenue to Employee Pay, Higher in Decade

" Jan. 20 (Bloomberg) -- Morgan Stanley, the world’s biggest brokerage, allocated 62 percent of revenue to pay employees in 2009, the highest ratio in more than a decade, as the firm added staff faster than it made money.

The compensation and benefits expense rose 31 percent to $14.4 billion as revenue climbed 28 percent, the New York-based company said today. Because Morgan Stanley added more than 15,000 employees in June through its Morgan Stanley Smith Barney wealth-management joint venture, average compensation per employee fell to $235,193 from $244,000 last year.

Wall Street firms including Morgan Stanley are under pressure from politicians and regulators to curb year-end bonuses after taxpayer funds helped the companies rebound from the financial crisis. At the same time, Morgan Stanley’s efforts to keep brokers at Smith Barney and hire 400 people for sales and trading added to compensation costs. The bank posted fourth- quarter earnings from continuing operations of $413 million today, missing analysts’ estimates on lower trading revenue."

Hedge Funds Hold Investors ‘Hostage’ After Decade’s Best Year

" Jan. 20 (Bloomberg) -- Hedge funds’ best year in a decade is giving little comfort to Jason D. Papastavrou.

The founder of New York-based ARIS Capital Management LLC, which has about $250 million invested in hedge funds, is still waiting to get back $155 million from 22 managers that restricted withdrawals in 2008.

“We don’t object to the illiquidity,” Papastavrou said in an interview. “We object to how some managers are abusing the situation and holding investors’ money hostage to generate fees.”

Hedge-fund firms including D.E. Shaw & Co. and Harbinger Capital Partners LLC that froze client assets during the financial crisis have yet to pay back a total of about $77 billion to investors, according to estimates by Credit Suisse Tremont Index LLC, which tracks hedge funds. That’s after the biggest stock-market rebound since the 1930s and a record rally in credit markets revived demand for some assets considered illiquid a year ago.

The market recovery helped managers post returns of 20 percent last year after losing a record 19 percent in 2008, according to Chicago-based Hedge Fund Research Inc. The gains exclude some hard-to-sell assets, such as emerging-markets real estate or aircraft-engine securitizations.

“While I’m sympathetic to managers who weren’t able to sell assets back in October and November 2008 because bids were hard to come by, there are few excuses more than 12 months later,” said Michael Rosen, chief investment officer of Angeles Investment Advisors LLC, a Santa Monica, California-based firm that advises clients on investing in hedge funds.

$1.4 Trillion Industry

At the end of last year, about 5.5 percent of the $1.4 trillion hedge-fund industry’s assets were restricted by managers, compared with 11.6 percent of what was a $1.5 trillion industry at the end of 2008, according to Credit Suisse Tremont Index, a joint venture of Credit Suisse Group AG and Tremont Capital Management Inc.

While some hedge funds don’t want to sell at prices that would harm remaining clients, others are using this as an excuse to retain assets to generate fees and remain in business, said John B. Trammell, chief executive officer of New York-based Cadogan Management LLC."

The Galleon Hedge Fund Inside Tipsters

"Over the weekend, the Wall Street Journal outed trader David Slaine as one of the cooperating sources in the Galleon case (although when reached at home and confronted about his role in the ring, Slaine told reporters “you’ve got the wrong guy”). Big D was first approached by the FBI in 2007, when authorities came to him with evidence he’d traded on inside info. Hoping to save himself, Slaine told prosecutors that his friend, Craig Drimal, was part of an “insider-trading conspiracy involving a wide ring of other hedge-fund managers and lawyers.” Obviously, throwing one’s colleague under the bus is no easy thing to do, especially when the guy also happens to be one of your close friends. Drimal and Slaine go way back— they were not just buds, but weight-lifting partners, too, which is probably the tightest bond of all (the two originally met during Slaine’s clubbing days, when Drimal was a bouncer at Vertical and “quickly formed a friendship based on a shared passion for weight lifting and their mutual ability to bench-press 400 pounds”). They were so close, in fact, that soon after taking a gig with Galleon, Big D convinced his bosses to give Drimal— then working as a bouncer at the Roxy— a job as an assistant at the firm. But along the way something must have happened. A confrontation. A blow-up. Something dark, at the gym, involving spotting, for Slaine to rat his special friend out like this. One thing I can tell you about Slaine is that he wouldn’t have done it unless provoked. Like the time at Morgan Stanley, in the nineties, with the French Fries."

The Biggest Whoppers of 2009 (Mostly Circulated By Email)

"Summary

Although 2009 was not an election year, it kept us exceptionally busy, and led to millions of visits to our site. In this year-end summary, we offer some of the worst examples of the falsehoods we encountered during the first year of the Obama administration.

The list of howlers includes the false claim that the stimulus bill would dictate to doctors what procedures they can and can’t perform, and assertions that health care legislation would require seniors to get advice on how to commit suicide. Democrats exaggerated the problems their legislation aims to fix — at one point Obama falsely accused an insurance company of being responsible for the death of an Illinois cancer patient. We debunked claims that the "swine flu" vaccine had killed some U.S. sailors, and another claim that a bill passed by the House would require homeowners to make expensive energy-saving modifications to their homes before they would be allowed to sell them. We dealt with false claims about levitating trains, "green jobs," gun control and — still — Obama’s place of birth.

If the year brought any signs that politicians as a class are getting any more truthful or less careless about their facts, we didn’t notice it. For a quick and (we hope) entertaining review of a spin-filled year, please read on to our "Analysis" section."

Obama chides banks' "audacity" for fighting fee

"WASHINGTON (Reuters) – President Barack Obama on Saturday slammed Wall Street's "audacity" for fighting a bailout fee he wants to slap on financial firms and said his Republican opponents had sided with big banks.

With Obama's popularity hovering around 50 percent and congressional elections in November, the White House wants to cast itself alongside ordinary Americans while branding Republicans as the party for the rich.

"Like clockwork, the banks and politicians who curry their favor are already trying to stop this fee from going into effect," Obama said in his weekly radio and Internet address.

"We're not going to let Wall Street take the money and run. We're going to pass this fee into law," Obama vowed after proposing a levy to raise up to $117 billion over the next 10 years to recoup projected losses on a taxpayer bank bailout.

A number of the banks have already repaid capital they received under the $700 billion bailout, called the Troubled Asset Relief Program, which was conceived in 2008 by Obama's predecessor, Republican George W Bush."

The Lighter Side of Finance - ATMs in Antartica

"I was fascinated when I learned that there was an ATM on Antarctica, specifically at McMurdo Station. Just because, you know, it's not like your local ATM that they can zip a service tech out to. So to sate my curiosity, I gave a ping to Wells Fargo, who manages that ATM--and got a chance to chat with David Parker. All shall be explained.

This interview was conducted via Skype on January 5, 2010."

What the Financial Crisis Commission Should Ask

"On the eve of the first hearing of the Financial Crisis Inquiry Commission, which will query the chiefs of the biggest U.S. banks on the causes of the financial crisis, The New York Times’s Andrew Ross Sorkin has some questions of his own.

In his latest DealBook column, Mr. Sorkin has drawn up a list of questions that the commission might want to consider posing to the likes of Goldman Sachs’s Lloyd C. Blankfein and Morgan Stanley’s John J. Mack when they convene in Washington on Wednesday."

Did Tudor’s Tensor really tank?

"It looks like managed futures funds had a rough go of it last year. Today, Bloomberg headlined that as an industry segment this was their worst fall since 1987, and then went on to call out Greenwich legend Paul Tudor Jones’ Tudor Tensor Fund as one of the lackluster performers.

Tudor Tensor actually didn’t lose that much money last year, though. In fact, while the fund’s performance ended negative 2.67 percent for 2009 compared to the HFN CTA/Managed Futures Index, which was up 1.34 percent, the fund was still able to grow its assets. According to investors, Tensor now has $1.1 billion after ending last year with about $870 million."

A Bank CEO "Bringing In His Own People"? Be Very Afraid.

"History is written by the victors, and so are organizational charts. So it was no surprise that Bank of America’s (BAC) new CEO, Brian Moynihan, demoted Greg Curl, the bank's chief risk officer and former rival for Moynihan's job. The financial press has reported that Moynihan, 50, wants to "bring in his own people." For shareholders, these are not encouraging words. Because history has also shown that it's usually a mistake to get rid of the couple of guys—the architects or consiglieres—who know how things work. These veterans tend to be micromanagers who build power by having everyone report to them and keep a lid on crucial information to stay on top. Curl was the only man allowed close enough to Ken Lewis to know how BofA was assembled.

The biggest error a new CEO in such a system can make is to overestimate his political leverage. Look at Citigroup’s (C) rocky history after the exit of micromanaging architect Sandy Weill. Weill was so detail-oriented that he acted as the de facto chief financial officer of the firm. After he left, the place went through five new CFOs in rapid succession—including Sallie Krawcheck—who all flamed out of the job because they couldn't break down (or accept) the institution's bewildering walls on financial information. Recently, Weill blamed his successors, Chuck Prince and Vikram Pandit, for mismanaging his vision."

Banks, experts eye possible ways around Obama fee

"That is already the case with U.S. President Barack Obama's proposed fee on banks, designed to ensure that Wall Street banks pay up to $117 billion to reimburse taxpayers for the financial bailout: Bankers, lawyers and consultants are already considering ways to avoid paying the fee.

"This law could be a real boon for lawyers and consultants like me. There are tremendous opportunities for coming up with new mechanisms to avoid it," said Bert Ely, a bank consultant in Alexandria, Virginia.

The fee idea has been public for only a matter of hours, so it is tough to say precisely how to avoid it. Final wording is a long way off as the proposal wends its way through the legislative process."

Voices That Dominate Wall Street Take a Meeker Tone on Capitol Hill

WASHINGTON — Summoned to Capitol Hill to explain their companies’ roles in the worst economic downturn since the Depression, leaders of four big Wall Street banks offered a largely clinical take on the financial crisis on Wednesday, pointing to lapses in risk management and government regulation but offering little sense of the turmoil’s human toll.

Wall St Must Pay "Mad Scientists" Well: Lobbyist

Some Wall Street executives in line for fat bonuses are akin to "mad scientists" whose brilliance justifies the size of their pay packages, the head of the U.S. Chamber of Commerce said on Tuesday.

Thomas Donohue, president of the biggest U.S. business lobbying group, said he empathized with public anger at big bonuses paid by banks that also received taxpayer bailouts -- but only up to a point.

"There are (compensation) numbers that seem obscene to the average person, and maybe to me," Donohue conceded, in response to a question.

But he said many recipients were being paid in stock and that the amounts reflected that they are "very unique kinds of people."

"They are like mad scientists," Donohue said at a news conference held to discuss the chamber's legislative priorities. "They are all mathematicians, and they are very mobile. They can go to private equity and hedge funds."

Midtown Bank

Wants to hire Quants and Developers out of: Citadel, GS, Barclays,
Citi, Timber Hill, Knight Capital and UBS AMM teams.

This is for an Automated Market Making (AMM) business that trades
Options. Sometimes these groups call themselves the AMM or Automated
Options Trading business or even OAMM.

The manager wants to hire quants only out of one of the AMM businesses
listed above. He would prefer a junior and mid-level guy (who knows
what he's doing but isn't making a million bucks yet) and they must be
working on desk or in some way directly with traders. He wants quants
that know how to make money. Checklist of requirements for quants:
Volatility modeling (this is 101 stuff), spread and size calibration,
calibration methods in general and how to calculate edge? If they
can't do any of this they are not right person.
These guys usually make 200k-1 million or more. He will pay what he needs to pay to get quant from one of the preferred shops.

He also wants to hire a pair of C++ developers for the trading desk,
preferably from one of the shops listed above, but they must come from
an AMM business and must have experience with exchange connectivity for
